Wrongful Death & When to Hire Gharibian Law

Our focus and specialty at Gharibian Law is primarily elder abuse and neglect cases, specifically those taking place in nursing homes. However, we have a few other law specialties that allow us to help other members of our community find justice for their loved ones. One of those areas of laws we practice is Wrongful Death

Wrongful Death

Under California Law, Wrongful Death includes deaths caused by preventable accidents, medical malpractice, occupational exposure to chemicals, and death as the result of criminal activity. Whatever the circumstances surrounding the death, a wrongful death claim must, by law, have the following elements:

  • A human being died;
  • This death was caused either by another’s negligence or another’s intent to cause harm (not necessarily death);
  • Surviving family members are suffering monetary injury as a result of the death; and
  • A personal representative for the decedent’s estate has been appointed.

Additionally, there must be a preponderance of evidence, which is less than is needed for other types of cases.

In order to file a wrongful death case, you must be “The decedent’s surviving spouse, domestic partner, children, and issue of deceased children.” Or you must be the beneficiary entitled to “the property of the decedent by intestate succession.” Or a descendent or dependent of the deceased, including a “putative spouse, children of the putative spouse, stepchildren, or parents.”

As a result of winning the wrongful death case, complainants could receive reward amounts equalling those related to medical expenses and funeral costs, money that would have been earned by the deceased, or amounts meant to compensate for loss of financial support or even loss of companionship.
